The right of preemption of agricultural real estates

Celem niniejszej pracy magisterskiej jest przedstawienie instytucji prawa pierwokupu nieruchomości rolnych i ewolucji, jaką przeszła w ostatnich latach. Nie sposób było przystąpić do omawiania owego instrumentu bez zaprezentowania ogólnej regulacji pierwokupu zawartej w kodeksie cywilnym. By ułatwić śledzenie zmian wprowadzanych przez ustawodawcę, w części mówiącej o pierwokupie rolnym praca została podzielona na rozdziały odrębnie traktujące o przedmiocie pierwokupu rolnego oraz o podmiotach zaangażowanych w korzystanie z tego instrumentu. We fragmencie dotyczącym Agencji Nieruchomości Rolnych znalazło się także omówienie instytucji prawa nabycia, którego jako instrumentu komplementarnego wobec pierwokupu nie można było pominąć. W kolejnym rozdziale znajduje się część dotycząca prawa pierwokupu sąsiedzkiego w kształcie, w jakim planowano je wprowadzić w Polsce ustawą o kształtowaniu ustroju rolnego z 5 sierpnia 2015r. Na końcu omówiłem skutki, jakie niesie ze sobą naruszenie przepisów kreujących pierwokup nieruchomości rolnych. W pracy znalazła się także prawnoporównawcza analiza instytucji pierwokupu sąsiedzkiego oraz dzierżawcy nieruchomości rolnych.

The aim of his master’s thesis is to present the institution of right of preemption of agricultural real estates and the evolution that it has undergone in recent years. It was impossible to start a discussion about this instrument without presenting a general regulation of right of preemption included in civil code. To make following changes introduced by legislator easier, this master’s thesis, in the part mentioning the right of preemption of agricultural real estates, was divided into separate chapters concerning objects and subjects involved into executing right of preemption of agricultural real estates. In the part mentioning the Agricultural Estate Agency there is discussion dealing with a right of acquisition, which is complementary to a right of preemption and thus impossible to skip in this thesis. After that, there is a part concerning right of neighborhood preemption in shape, in which it was planned to be introduced in Poland with bill regarding formation of agricultural system from August 5, 2016. In the last chapter I discussed consequences of violating rules of law that govern the institution of right of preemption of agricultural real estates. In this master’s thesis, there is also included comparative legal analysis of right of neighborhood preemption and lessee of agricultural real estates.
