The maintenance obligation of the spouses

Opracowanie traktuje o obowiązku alimentacyjnym między małżonkami w trakcie trwania małżeństwa oraz po orzeczeniu rozwodu, chociaż wspomina także o obowiązku alimentacyjnym w relacjach rodzic-dziecko niepełnoletnie lub niesamodzielne. Praca została podzielona na cztery części. Pierwsza dotyczy charakterystyki małżeństwa jako podstawy założenia rodziny w ujęciu prawnym i socjologicznym. W drugim rozdziale przedstawiono charakterystykę obowiązku alimentacyjnego, wyjaśniając to pojęcie, jego funkcje, zakres i cechy swoiste. Pozostałe dwa rozdziały (trzeci i czwarty) dotyczą stricte obowiązku alimentacyjnego na różnych etapach stosunków między małżonkami tj. podczas trwania małżeństwa oraz po jego ustaniu. W części trzeciej na wstępie przedstawiono przesłanki aktualizacji obowiązku alimentacyjnego w trakcie trwania małżeństwa, a w późniejszych podrozdziałach omówiono obowiązek małżonków przyczyniania się do zaspokajania potrzeb rodziny oraz zasadę równej stopy życiowej. Ostatni rozdział opisuje obowiązek alimentacyjny po ustaniu małżeństwa. Omówiono w nim przesłanki aktualizacji obowiązku alimentacyjnego po orzeczeniu rozwodu oraz zagadnienie obowiązku alimentacyjnego w kontekście winy. W pierwszym podrozdziale opisano obowiązek alimentacyjny w sytuacji, kiedy sąd orzeka o winie obojga małżonków bądź wstrzymuje się od ustalenia winy rozkładu pożycia, w drugim podrozdziale omówiono przesłanki aktualizacji obowiązku alimentacyjnego, gdy tylko jeden z małżonków zostaje uznany winnym rozkładu pożycia, co może wiązać się z pogorszeniem sytuacji materialnej małżonka niewinnego. W ostatnim podrozdziale zostało omówione zagadnienie alimentów, które zostały przyznane w sposób sprzeczny z zasadami współżycia społecznego.

The diploma work deals with maintenance obligations between spouses during the marriage and after divorce, though it also mentions maintenance obligations in parent-child relationships, minors or dependent children.The diploma work has been divided into four parts. The first part concerns the characteristics of marriage as the basis for establishing a family in legal and sociological terms. The second chapter presents the characteristics of the maintenance obligation, explaining the concept, its functions, scope and characteristics. The other two chapters (third and fourth) deal strictly with the maintenance obligation at different stages of the relationship between the spouses, during the marriage and after the marriage. The third part introduces the premise of updating the maintenance obligation during the marriage and in the following sections discusses the obligation of the spouses to contribute to satisfying the needs of the family and the principle of equal living. The last chapter describes the maintenance obligation after the marriage ceases. It discusses the prerequisites for updating the maintenance obligation after the divorce decree and the issue of maintenance obligation in the context of fault. In the first section, the maintenance obligation is described when the court finds that the spouses have been guilty of the offense or refrains from finding fault with the distribution of life. The second subsection discusses the conditions for updating the maintenance obligation as soon as one of the spouses is found guilty. The last subsection discusses the issue of maintenance, which has been granted in a manner contrary to the principles of social coexistence.
