Termination of employment for an indefinite period by notice

Tematem pracy jest jeden ze sposobów rozwiązania umowy o pracę, a mianowicie wypowiedzenie umowy na czas nieokreślony. Umowa o pracę na czas nieokreślony jest podstawową jaką zawierają pracodawca i pracownik. Moja praca magisterska zawiera definicję umowy o pracę oraz wypowiedzenia. Praca składa się z czterech rozdziałów. Pierwszy z nich prezentuje przyczyny rozwiązania umowy o pracę na czas nieokreślony za wypowiedzeniem. Drugi rozdział zawiera definicję okresu wypowiedzenia umowy o pracę zawartej na czas nieokreślony oraz szczególne przypadki umożliwiające skrócenie tego okresu. Rozdział trzeci porusza problem trybu wypowiedzenia umowy o pracę na czas nieokreślony. Przedstawia udział zakładowej organizacji związkowej w rozwiązywaniu umowy o pracę oraz wpływ jej stanowiska na ostateczną decyzję pracodawcy w zakresie dokonania wręczenia wypowiedzenia umowy o pracę. Ten rozdział obejmuje także systemową ochronę trwałości stosunku pracy. Ostatni czwarty rozdział pracy opowiada o zwolnieniach z przyczyn niedotyczących pracowników oraz o roszczeniach z tytułu wadliwego dokonania wypowiedzenia umowy o pracę. Podstawowymi żródłami wykorzystanymi w pracy magisterskiej są: literatura przedmiotu, akty prawa polskiego oraz bogate orzecznictwo w tym zakresie. Uzupełnieniem mojej pracy magisterskiej są własne przemyślenia.

The theme of the work is one way to terminate the contract, namely the termination of the contract of indefinite duration. The employment contract of indefinite duration which is the main include employer and employee. My master thesis contains a definition of contract of employment and termination. The work consists of four chapters. The first one presents the reasons for termination of employment for an indefinite period for the notice. The second chapter contains a definition of the period of notice of termination of employment for an indefinite period and for specific cases for a shorter period. The third section discusses the problem of mode of termination of employment of indefinite duration. Shows the share of the trade union organization in dealing with employment contracts and the impact of its position on the final decision on employers to make giving notice of termination of employment. This chapter also includes a system of employment protection for durability. The last fourth chapter talks about work exemptions for reasons not related to employees and the claims made for the faulty termination of employment. The main sources used for quarterly thesis are: literature, acts of Polish law and the rich case law in this regard. Complement to my thesis are my own thoughts.
