Evidence contract in proceedings in commercial matters

Tematem niniejszej pracy jest instytucja umowy dowodowej w postępowaniu w sprawach gospodarczych. W rozdziale pierwszym omówiono zagadnienia ogólne dotyczące postępowania cywilnego oraz problematyki umów dowodowych. Takie teoretyczne wprowadzenie pozwala zrozumieć genezę analizowanej instytucji oraz poznać uwarunkowania, ze względu na które doszło do jej wprowadzenia. Rozdział drugi został poświęcony analizie treści umowy dowodowej (tj. zarówno jej elementów konstytutywnych, jak i fakultatywnych). Przedmiotem ostatniego (trzeciego) rozdziału jest problematyka skuteczności umowy dowodowej. Omówiono w nim warunki skuteczności umowy dowodowej, skutki, jakie umowa ta może wywrzeć względem toczącego się postępowania oraz problematykę wadliwości tej umowy. W podsumowaniu pracy dokonano zwięzłej oceny obowiązujących przepisów i sformułowano postulaty de lege ferenda pod adresem ustawodawcy.

The subject of this work is the institution of an evidence contract in proceedings in commercial matters. The first chapter discusses general issues of civil procedure and the problem of evidence contracts. Such a theoretical introduction allows to understand the genesis of the analysed institution and to get acquainted with the conditions that led to its introduction. The second chapter is devoted to the analysis of the content of an evidence contract (i.e. both its constitutive and optional elements). The subject of the last (third) chapter is the issue of the validity of the evidence contract. It discusses the conditions for the validity of an evidence contract, the impact that such an agreement may have in relation to pending proceedings and the issue of the invalidity of such an agreement. The work concludes with a brief assessment of the current provisions and formulates de lege ferenda postulates to the legislator.
