Numerus clauses in consular notarial activities provided in article 28 of the Consular Law : an analysis of errors in the national legislation

Międzynarodowe prawo konsularne jednoznacznie przewiduje możliwości dokonywania czynności notarialnych przez konsulów państwa wysyłającego. Są to jednakże czynności, których wykonywanie zależy od przyzwolenia państwa przyjmującego. W prawie polskim od 1924 r. do 2019 r. obowiązywały regulacje przewidujące otwarty katalog czynności notarialnych konsulów. Dawało to potencjalną możliwość aktywności notarialnej konsulów polskich w przypadku pojawiania się w prawie polskim nowych czynności notarialnych. W 2019 r. doszło do istotnej zmiany w analizowanym okresie. Artykuł omawia przyczyny zamknięcia katalogu czynności notarialnych konsulów w polskiej ustawie z dnia 25 czerwca 2015 r. Prawo konsularne, zastosowane zmiany legislacyjne oraz konsekwencje takiego zabiegu dla bieżącej praktyki konsularnej polskich konsulów.

International consular law explicitly provides the possibility of notarial activities by consuls of the sending State. However, the performance of these activities depends on the consent of the receiving State. In Polish law, from 1924 to 2019, regulations providing an open catalogue of consular notarial activities were in force. These kinds of regulations gave Polish consuls the possibility of notarial activities in case of the emeregence of new notarial activities in Polish law. In 2019, there was a significant change in Polish law in this regard. The article discusses the reasons for the introduction of numerus clauses in the catalogue of consular notarial activities provided in the act of 25 June 2015 on Consular Law, the legislative changes applied and the consequences of such changes for the current consular practice of Polish consuls.
