The Course of Prescriptive Procedure

Tematem niniejszej pracy jest przebieg postępowania nakazowego. Przedmiotem pierwszego rozdziału są ogólne kwestie dotyczące przebiegu postępowania nakazowego, z uwzględnieniem jego rysu historycznego oraz charakteru. Rozdział drugi poświęcony jest wszczęciu postępowania nakazowego. Omówiono w nim przede wszystkim wymagania pozwu, które muszą zostać spełnione, aby możliwe było wydanie nakazu zapłaty w tym postępowaniu. W rozdziale trzecim scharakteryzowano przebieg postępowania nakazowego, z uwzględnieniem problematyki nakazu zapłaty jako tytułu zabezpieczenia oraz kwestii dotyczących wniesienia zarzutów od nakazu zapłaty w postępowaniu nakazowym. Ostatni (czwarty) rozdział niniejszego opracowania jest poświęcony analizie możliwości zbiegu postępowania nakazowego z innymi postępowaniami odrębnymi.
The course of prescriptive procedure is the subject of the master’s thesis. In the first chapter basic issues concerning the course of prescriptive procedure, including its historical overview and nature are presented. Second chapter is devoted to initiation of the procedure. Necessary lawsuit elements enabling court to issue an order for payment in this proceeding are presented therein. Chapter three describes the course of prescriptive procedure, considering the issue of the order for payment as the title of the security and the issues relating to lodging allegations against the order for payment in the prescriptive procedure. The last (fourth) chapter of this master’s thesis is devoted to the cumulation of the prescriptive procedure and other separate proceedings.
