Technical and aesthetic functionality as an absolute obstacles of trademark registration

Znaki towarowe odgrywają istotną rolę we współczesnej gospodarce. Coraz większej popularności nabywają niekonwencjonalne znaki towarowe, zwłaszcza oznaczenia przestrzenne. Pomimo dużej ilości zgłoszeń, tylko niektóre oznaczenia nadają się do rejestracji w charakterze znaku towarowego.W tej pracy magisterskiej skupiłam się na analizie przeszkód rejestracyjnych znaków towarowych z uwagi na funkcjonalność techniczna oraz estetyczną. Zarysowano występujące problemy przy ich wykładni, a także propozycje ich rozwiązania. Głównym celem istnienia tych przeszkód jest ochrona konkurencji, interesu publicznego oraz rozgraniczenie reżimu znaków towarowych od innych reżimów ochronnych prawa własności intelektualnej. Przedstawienie problemu badawczego zaczyna się od ogólnej charakterystyki znaków towarowych, reżimu ochronnego oraz bezwzględnych przeszkód rejestracyjnych. Zwrócono uwagę również na niemożliwość obejścia wskazanych przeszkód za pomocą nabycia wtórnej zdolności odróżniającej. W dalszej części pracy omówiono interpretacje funkcjonalności technicznej oraz estetycznej w literaturze przedmiotu i wybranym orzecznictwie TSUE. Ponadto osobna część pracy została poświęcona dopuszczalności ochrony kumulatywnej znaków towarowych i wzorów przemysłowych, wynalazków oraz wzorów użytkowych.

Trademarks play an important role in the modern economy. Unconventional trademarks, especially three dimensional, are gaining more and more popularity. Despite the large number of applications, only some can be registered as a trademark.In this master's thesis, I focused on the analysis of the obstacles of trademark registration due to technical and aesthetic functionality. Problems with their interpretation are outlined, as well as suggestions for their solutions. The main purpose of these obstacles is to protect competition, the public interest and to separate the trademark regime from other intellectual property protection regimes.The thesis begins with the general characteristics of trademarks, their protection regime, and absolute obstacles of registration. Attention was also drawn to the impossibility of going around the indicated obstacles by obtaining secondary distinguish ability. I’ve also described the interpretations of technical and aesthetic functionality in the doctrine and in selected ECJ jurisdiction. Moreover, a separate part of this thesis devoted to the admissibility of cumulative protection of trademarks and industrial designs, inventions and utility models.
