Clearing system in FIDIC Forms of Contracts

Celem niniejszej pracy jest omówienie w sposób kompleksowy sposobów rozliczeń inwestycji budowlanych opartych na warunkach kontraktowych FIDIC. Warunki kontraktowe FIDIC są najpopularniejszymi i najczęściej stosowanymi wzorcami umownymi przy realizacji dużych inwestycji budowlanych. W pierwszym rozdziale pracy zostały określone sposoby zastosowania Warunków Kontraktowych w Polsce. Porównano również typową dla wzorców umownych instytucję Inżyniera Kontraktu z Inspektorem Nadzoru Inwestorskiego. Następnie zostały poruszone kwestie dotyczące różnić w rozliczeniu wynagrodzenia obmiarowego (kosztorysowego) oraz ryczałtowego. Opisano też problemy zachodzące w sytuacji rozliczania inwestycji z podwykonawcami. Kolejny rozdział miał na celu analizę prawa wykonawcy do dodatkowego wynagrodzenia za roboty wprowadzone na podstawie polecenia zmiany. W ostatnim rozdziale porównano sposoby rozliczenia na podstawie konkretnych wzorów FIDIC i określono różnice zachodzące pomiędzy nimi.

The aim of this paper is to discuss in an exhaustive way the settlement methods of construction investment based on FIDIC conditions of contracts. These terms are the most prevalent and the most commonly used contract templates in the processing of serious construction projects. The first chapter of this essay determines the methods of applying the Conditions of contracts in Poland. The comparison of typical institutions of contract templates which are Contract Engineer and the Investor's Supervision Inspector is included afterwards. Then, the paper reviews differences in the settlement of remuneration by cost estimation and lump-sum payment. Complications appears in the situation of settling investments with subcontractors are also mentioned. The alternate chapter was meant to analyze the contractor's right to extra consideration for services based on change order. The last chapter compares the settlement methods on the ground of specific FIDIC forms and states differences between them.
