Internet user's liability for internet piracy with emphasis on computer games

Z roku na rok co raz większe znaczenie w życiu ludzi odgrywa internet. Obecnie jest on medium, bez którego spora część społeczeństwa nie potrafi żyć. Jest źródłem zarówno wielu dobrodziejstw, jak i wielu niebezpieczeństw. Kontrowersyjnym tematem związanym z internetem, jest niewątpliwie legalność pobierania i udostępniania plików. W pracy poruszony został temat piractwa internetowego oraz odpowiedzialność karnej i cywilnej, która grozi osobom pobierającym i udostępniającym nielegalnie utwory w sieci. Pierwszy rozdział przedstawia krótką historię internetu, wraz z opisaniem narzędzi, które pozwoliły na rozwój udostępniania plików między internautami. Następnie w pracy została podjęta próba zdefiniowania piractwa internetowego, ze względu na brak legalnej definicji tego terminu w polskim ustawodawstwie. W kolejnym rozdziale opisano instytucję dozwolonego użytku osobistego oraz jej wpływ na legalność działania internautów, związanego z pobieraniem i udostępnianiem plików w sposób niełamiący prawa. Następnie, w związku z bardzo dużym wpływem na odpowiedzialność prawną, podjęto próbę zakwalifikowania gier komputerowych do jednej z kategorii utworów. W ostatnim rozdziale poruszony został temat odpowiedzialności karnej i cywilnej internauty, jako użytkownika końcowego, za piractwo internetowe.

From year to year, the Internet plays an increasingly important role in people's lives. Currently, it is a medium without which a large part of society can not live. It is the source of both many favors and many dangers. Legality of downloading and uploading files to the web is undoubtedly a controversial topic related to the internet itself. The work touched on the topic of internet piracy and criminal and civil liability, which threatens people downloading and sharing files in the Internet illegally. The first chapter presents a brief history of the internet, along with the description of tools that allowed for the development of file sharing among internet users. Then, an attempt was made to define internet piracy, due to the lack of a legal definition of this term in Polish legislation. The next chapter describes the institution of permitted personal use and its impact on the legality of internet users' actions connected with downloading and sharing files in a way that does not violate the law. Then, due to a very large impact on legal liability, an attempt was made to qualify computer games for one of the categories of works. The last chapter discusses the subject of criminal and civil liability of the Internet user, as the end user for internet piracy.
