Clash of procedural justice with substantive justice - the case of Patrycja Waszczuk

Niniejsza praca podejmuje problematykę zasady sprawiedliwości materialnej i zasady sprawiedliwości proceduralnej na przykładzie sprawy Patrycji Waszczuk. Celem pracy jest próba przedstawienia różnorodności relacji występujących pomiędzy wskazanymi wyżej zasadami. Pierwszy rozdział poświęcony jest rozważaniom na temat definicji sprawiedliwości oraz kwestiom związanym z jej wieloaspektowością. Następnie w kolejnym rozdziale, poruszona została kwestia sprawiedliwości proceduralnej, jej definicji oraz tego, jak postrzegana jest w różnych dziedzinach prawa. Wyodrębniona została ponadto zasada sprawiedliwości materialnej. W trzecim rozdziale pracy poruszona została sprawa oskarżonej o doping elektroniczny szachistki. Dokonana została analiza postępowania dyscyplinarnego Polskiego Związku Szachowego i występujących w nim licznych uchybień, a także szczegółowa analiza naczelnych zasad procesowych. W oparciu o powyższe dokonana została próba wskazania relacji zasad sprawiedliwości proceduralnej i materialnej. W podsumowaniu zostały zawarte wnioski końcowe dotyczące obu wskazanych zasad.

This thesis deals with the principle of substantive justice and the principle of procedural justice on the example of the case of Patrycja Waszczuk. The aim of this thesis is to present the diversity of relations between the principles indicated above. The first chapter is devoted to considerations on the definition of justice and issues related to its multifaceted nature. Then, in the next chapter, the issue of procedural fairness, its definition and how it is perceived in various areas of law is discussed. Moreover, the principle of substantive justice has been distinguished. The third chapter of the thesis deals with the case of a chess player accused of electronic doping. An analysis of the disciplinary proceedings of the Polish Chess Federation and its numerous shortcomings was carried out, as well as a detailed analysis of the main procedural principles. Based on the above, an attempt was made to indicate the relationship between the principles of procedural and substantive justice.The summary contains final conclusions regarding both of these principles.
