dc.abstract.enAbstractThis thesis is devoted to an analysis of the concept of the constitution in the thought of Carl Schmitt, with particular emphasis on his theory of sovereignty, the relativization of the constitution, and his doctrine of dictatorship. The first part examines the ambiguity of the concept of the constitution and the distinction between the constitution understood in an absolute sense and in a relative sense. It then discusses the concept of constitutional sovereignty, the significance of constitutional amendment procedures, and the consequences of different understandings of the constitution for the functioning of the political community.The next part of the thesis focuses on the constitution as a political pact and as a fundamental law. It also presents the historical development of the modern concept of the constitution and its influence on contemporary state theory. Particular attention is devoted to Schmitt’s views on the relationship between political decision, sovereignty, and constitutional order.The subsequent part examines Schmitt’s theory of dictatorship and its place within a state governed by the rule of law. It analyzes the institution of the state of exception and Schmitt’s interpretation of Article 48 of the Weimar Constitution. Furthermore, it discusses the concept of extraordinary lawmakers operating within the constitutional system of the Weimar Republic, with particular emphasis on the extraordinary legislator ratione materiae, ratione supremitatis, and ratione necessitatis.The analysis leads to the conclusion that Schmitt’s theory of the constitution constitutes an attempt to reconcile the normative dimension of law with the political dimension of sovereignty. At the same time, it reveals the tension between the stability of the constitutional order and the necessity of responding to extraordinary situations that threaten the existence of the state.pl
dc.abstract.plPraca poświęcona jest analizie pojęcia konstytucji w myśli Carla Schmitta ze szczególnym uwzględnieniem jego teorii suwerenności, relatywizacji konstytucji oraz nauki o dyktaturze. W pierwszej części przedstawiono wieloznaczność pojęcia konstytucji oraz rozróżnienie między konstytucją rozumianą w sensie absolutnym i relatywnym. Następnie omówiono koncepcję suwerenności konstytucji, znaczenie procedury zmiany ustawy konstytucyjnej oraz konsekwencje przyjęcia różnych sposobów rozumienia konstytucji dla funkcjonowania wspólnoty politycznej.Kolejna część pracy poświęcona została analizie konstytucji jako umowy politycznej oraz ustawy zasadniczej. Przedstawiono również historyczny rozwój nowoczesnego pojęcia konstytucji i jego wpływ na współczesną teorię państwa. Szczególną uwagę poświęcono poglądom Schmitta dotyczącym relacji między decyzją polityczną, suwerennością i porządkiem konstytucyjnym.W dalszej części pracy omówiono Schmittowską teorię dyktatury oraz jej miejsce w państwie prawa. Analizie poddano instytucję stanu wyjątkowego oraz interpretację art. 48 Konstytucji Weimarskiej. Przedstawiono również koncepcję nadzwyczajnych prawodawców występujących w systemie konstytucyjnym Republiki Weimarskiej, ze szczególnym uwzględnieniem prawodawcy nadzwyczajnego ratione materiae, ratione supremitatis oraz ratione necessitatis.Przeprowadzone rozważania prowadzą do wniosku, że Schmittowska teoria konstytucji stanowi próbę pogodzenia normatywnego wymiaru prawa z politycznym wymiarem suwerenności. Jednocześnie ukazuje ona napięcie pomiędzy stabilnością porządku konstytucyjnego a koniecznością reagowania na sytuacje nadzwyczajne zagrażające istnieniu państwa.pl
