European order for payment procedure

Niniejsza praca dyplomowa stanowi analizę postępowania wprowadzonego przez Rozporządzenie (WE) nr 1896/2006 Parlamentu Europejskiego i Rady z dnia 12 grudnia 2006 r. ustanawiające postępowanie w sprawie europejskiego nakazu zapłaty. Rys historyczny pracy przedstawia rozwój instytucji współpracy sądowej w sprawach cywilnych, której rozwój doprowadził do wprowadzenia postępowania w sprawie europejskiego nakazu zapłaty. Postępowanie zostało omówione głównie z perspektywy polskiego systemu prawnego – przyjętych w nim rozwiązań oraz sposobu jego funkcjonowania. Praca stara się odpowiedzieć na pytanie czy cele założone w rozporządzeniu przez prawodawcę unijnego zostały zrealizowane, a także które regulacje wymagają modyfikacji. Skupiono się także na ocenie rozporządzenia z perspektywy czasu na podstawie badań statystycznych przeprowadzonych na jego temat.

This M.A. thesis i an analysis of the Regulation (EC) No 1896/2006 of the European Parliament and the Council of 12 December 2006 creating a European order for payment procedure. Historical part of the thesis presents development of cooperation in civil matters in European Union regulations which development led to the introduction of a European order for payment procedure. The proceedings were discussed mainly from the perspective of the Polish legal system, the solutions adopted and the way in which the European order for payment procedure operates. The thesis tries to answer the question whether the objectives premised in the regulation by the European Union legislator have been implemented and also which regulations needs modification. The focus of the thesis was also put on the assessment of the regulation in retrospect on the basis of statistical surveys carried out on in.
