Legal aspects of euthanasia based on the example of the regulations of selected countries of the world

Praca poświęcona została przede wszystkim aspektom prawnym eutanazji. Zaprezentowano w niej problematykę wprowadzającą do zagadnienia eutanazji, a tym samym ukazano jak zmieniało się postrzeganie i definiowanie pojęcia „eutanazja” na przestrzeni wieków. Przedstawiono w niej również regulacje prawne eutanazji w ujęciu historycznym, a także opisano materię związaną z rodzajami eutanazji. W pracy ponadto omówiono problematykę eutanazji na gruncie polskiego prawa, doktryny i orzecznictwa sądów. W tym zakresie wskazano ujęcie eutanazji w świetle norm konstytucyjnych oraz przyjęte przez polskie prawo karne rozwiązanie dotyczące eutanazji. Przedstawiono również kwestie prawne związane z eutanazją w zawodzie lekarza. W pracy zaprezentowano także eutanazję w trzech wybranych państwach świata: Australii, Stanach Zjednoczonych Ameryki na przykładzie stanu Oregon, Holandii. Przedstawienie w przedmiotowym zakresie ustawodawstw wskazanych krajów, pozwoliło zobrazować różnorodność regulacji prawnych przyjmowanych przez poszczególne państwa. W konsekwencji, na potrzeby pracy przyjęto szeroką definicję pojęcia „eutanazja”, obejmującą wszelkie formy zachowań eutanatycznych.

The thesis was devoted primarily to the legal aspects of euthanasia. The introductory topic to the issue of euthanasia was presented, and thus how the perception and definition of the concept of „euthanasia” had changed over the centuries was also showed in the thesis. The legal regulations of euthanasia from a historical perspective were presented, and the matter related to the types of euthanasia was described as well. Besides, in the thesis the issue of euthanasia on the basis of the Polish law, doctrine and courts’ decisions was presented. In this regards, the regulations of euthanasia in constitutional norms and the solution of euthanasia adopted by the Polish criminal law were indicated. Additionally, the legal issues related to euthanasia in the medical profession were also presented. In this thesis euthanasia in three selected countries of the world: Australia, the United States of America on the example of the state of Oregon, the Netherlands was presented. A presentation of the legislation of the countries indicated in this regard has made it possible to illustrate the diversity of legal regulations adopted by individual countries. As a consequence, a broad definition of the term „euthanasia” which includes all forms of euthanasia was adopted for the needs of the thesis.
