Article 192 of the Penal Code as a criminal law instrument protecting the patient autonomy

Praca magisterska porusza problematykę przestępstwa stypizowanego w art. 192 Kodeksu karnego w zakresie jego przedmiotu ochrony oraz analizy znamion strony przedmiotowej. W pierwszej kolejności omówione zostało zagadnienie autonomii człowieka przejawiającej się w jego prawie do samostanowienia o sobie oraz relacji tego prawa do takich wartości jak życie i zdrowie. Następnie dokonano interpretacji i zakreślenia granic znamion "zabiegu leczniczego" oraz "zgody" pacjenta, ze szczególnym uwzględnieniem warunków, które przesądzają o jej prawnej skuteczności. Powyższe rozważania przeprowadzono w oparciu o przepisy z zakresu prawa medycznego, aktualne orzecznictwo sądowe oraz poglądy doktryny.

The master’s thesis discusses the issue of crime described in Article 192 of the Penal Code with regard to the subject of its protection and analysis of the objective elements. At the begining, autonomy patient’s was discussed and the relation of this right to such values as life and health. Then, the concepts and frames of these two terms: medical treatment and the patient's consent were defined, with particular emphasis on the conditions that determine its legal effectiveness. The above considerations were based on the provisions of medical law, current judicial decisions and views of doctrine.
