dc.abstract.enThe subject of this thesis is the analysis of consumer protection in electronic commerce in the light of the activities of the President of the Office of Competition and Consumer Protection (UOKiK). The dynamic development of e-commerce has led to a significant increase in distance contracts, providing consumers with greater convenience while simultaneously creating new risks and challenges. The thesis presents the fundamental concepts of consumer protection under Polish and European Union law, the characteristics of electronic commerce, and the role and competences of the President of UOKiK in safeguarding consumer rights. Particular attention is devoted to unfair commercial practices occurring in the digital environment. The thesis discusses the most common forms of consumer rights violations, including misleading information, manipulation of promotions and prices, concealment of important commercial information, and the use of so-called dark patterns, which are deceptive interface designs intended to influence consumers’ purchasing decisions. The analysis also covers the significance of the Omnibus Directive as a legal instrument strengthening consumer protection by increasing market transparency and introducing obligations related to displaying the lowest price of a product within the previous thirty days. The thesis further examines proceedings conducted by the President of UOKiK concerning infringements of collective consumer interests and the legal measures used to eliminate unfair practices from the market. The empirical part of the study includes an analysis of selected cases investigated by UOKiK, particularly those involving the online stores Born2Be and Renee, as well as the e-commerce platforms Zalando and Temu. These examples make it possible to assess the effectiveness of public enforcement mechanisms in protecting consumers within the e-commerce sector. The analysis leads to the conclusion that the rapid development of electronic commerce requires the continuous adaptation of consumer protection mechanisms to new technological challenges. The activities of the President of UOKiK play a crucial role in ensuring market transparency and protecting collective consumer interests; however, effective consumer protection also requires the ongoing development of legal regulations and the improvement of consumer awareness.pl
dc.abstract.plPrzedmiotem niniejszej pracy jest analiza ochrony konsumentów w handlu elektronicznym w świetle działań Prezesa Urzędu Ochrony Konkurencji i Konsumentów. Dynamiczny rozwój e-commerce spowodował wzrost liczby transakcji zawieranych na odległość, co przyczyniło się zarówno do zwiększenia wygody zakupów, jak i pojawienia się nowych zagrożeń dla konsumentów. W pracy przedstawiono podstawowe zagadnienia związane z pojęciem konsumenta w prawie polskim i unijnym, charakterystykę handlu elektronicznego oraz rolę i kompetencje Prezesa UOKiK w zakresie ochrony praw konsumentów. Szczególną uwagę poświęcono problematyce nieuczciwych praktyk rynkowych występujących w środowisku cyfrowym. Omówiono najczęściej spotykane formy naruszeń, takie jak wprowadzanie konsumentów w błąd, manipulowanie promocjami i cenami, ukrywanie istotnych informacji handlowych oraz wykorzystywanie tzw. dark patterns, czyli zwodniczych interfejsów wpływających na decyzje zakupowe użytkowników. Przeanalizowano również znaczenie Dyrektywy Omnibus jako instrumentu wzmacniającego ochronę konsumentów poprzez zwiększenie transparentności działań przedsiębiorców oraz obowiązek informowania o najniższej cenie produktu z ostatnich 30 dni. W pracy przedstawiono także procedury prowadzenia przez Prezesa UOKiK postępowań dotyczących naruszenia zbiorowych interesów konsumentów oraz instrumenty prawne służące eliminowaniu nieuczciwych praktyk z rynku. W części badawczej dokonano analizy wybranych spraw prowadzonych przez UOKiK, w szczególności dotyczących sklepów internetowych Born2Be i Renee, a także platform Zalando i Temu. Przykłady te pozwoliły ocenić skuteczność działań organu w przeciwdziałaniu naruszeniom praw konsumentów w sektorze e-commerce. Przeprowadzona analiza prowadzi do wniosku, że rozwój handlu elektronicznego wymaga stałego dostosowywania instrumentów ochrony konsumentów do nowych zagrożeń wynikających z postępu technologicznego. Działania Prezesa UOKiK odgrywają istotną rolę w zapewnianiu przejrzystości rynku oraz ochronie zbiorowych interesów konsumentów, jednak skuteczna ochrona wymaga również ciągłego rozwoju regulacji prawnych oraz podnoszenia świadomości konsumenckiej.pl
