The European Union as a party to an international agreement

Przedmiotem pracy magisterskiej jest analiza procesu zawierania umów międzynarodowych przez Unię Europejską oraz posiadane przez nią kompetencje w tym obszarze. Rozważania zostały poparte analizą procesu zawierania przez UE wybranych umów międzynarodowych. Celem pracy jest zbadanie uwarunkowań prawnych zawierania przez UE umów międzynarodowych oraz ocena ich realizacji poprzez analizę konkretnych przypadków. Autorka stawia hipotezę, iż zawierane przez UE umowy międzynarodowe stanowią istotny element unijnego porządku prawnego, wywierający wpływ na jej autonomię prawną, a także sytuacje polityczną, społeczną i ekonomiczną wewnątrz UE oraz na arenie międzynarodowej. Praca została podzielona na trzy rozdziały. W pierwszym przedstawiono prawne podstawy dla zawierania przez UE umów międzynarodowych. W drugim rozdziale zawarto analizę procedury zawierania tych umów. W ostatnim z rozdziałów przeprowadzono analizę procesu zawierania przez UE trzech wybranych umów międzynarodowych takich jak: przystąpienie Unii Europejskiej do europejskiej Konwencji o ochronie praw człowieka i podstawowych wolności, Paryskie porozumienie klimatyczne oraz umowa gospodarczo-handlowa z Japonią (EPA).

The subject of the master's thesis is the analysis of the process of concluding international agreements by the European Union and its competences in this area. The considerations are supported by an analysis of the process of concluding selected international agreements by the EU. The aim of the thesis is to examine the legal conditions for concluding international agreements by the EU and to assess their implementation through the analysis of specific cases. The author puts forward the hypothesis that international agreements concluded by the EU constitute an important element of the EU legal order, influencing its legal autonomy, as well as the political, social and economic situation within the EU and in the international arena. The thesis is divided into three chapters. The first presents the legal basis for concluding international agreements by the EU. The second chapter contains an analysis of the procedure for concluding these agreements. The last chapter analyses the process of concluding three selected international agreements by the EU, such as: the accession of the European Union to the European Convention for the Protection of Human Rights and Fundamental Freedoms, the Paris Climate Agreement and the Economic and Trade Agreement with Japan (EPA).
