The non-competition agreement during the employment

Celem niniejszej pracy jest przybliżenie zagadnienia umowy o zakazie konkurencji w trakcie trwania stosunku pracy. Praca składa się z czterech rozdziałów. Rozdział pierwszy dotyczy ogólnych informacji o tej umowie (historia, umowa o zakazie konkurencji a obowiązek dbałości o dobro zakładu pracy, zasada wolności gospodarczej i zasada wolności pracy). Drugi rozdział poświęcony jest strukturze umowy (jej strony, odpłatność, zakres zakazu konkurencji). Kolejny rozdział przedstawia następstwa prawne odmowy zawarcia umowy o zakazie konkurencji w czasie trwania stosunku pracy. Ostatni rozdział traktuje o konsekwencjach naruszenia umowy. Praca została napisana głównie w oparciu o opracowania naukowe oraz orzecznictwo.

The purpose of this project is to present the issue of non-competition agreements during employment. The study consists of four chapters. The first, presents general information about the agreement (its history, non-competition agreement versus the employee’s solicitude duty and the principle of economic freedom versus the right to work). The second chapter describes the structure of non-competition agreement during employment (sides of the contract, issues over payment and the scale of the non-competition). The third chapter looks into the legal consequences when one side declines to sign the non-competition agreement. The last chapter deals with the possible consequences of infringement of this agreement. This work has mainly been conducted on the basis of literature review, case studies and legal compilation.
