Opracowanie dotyczy prawnych i systemowych uwarunkowań ustalania niższego i obniżonego wieku emerytalnego w ramach obecnie obowiązujących norm prawnych z uwzględnieniem celów, jakie stały za reformą systemu emerytalnego, oraz rozwiązań mających za zadanie łagodzenie skutków reformy. Ustalenie właściwego wieku emerytalnego zgodnego z założeniami ustawodawcy, daje wnioskodawcom gwarancję prawidłowego stosowania prawa. Liczne kolejne odesłania zawarte w podstawowym dla emerytur akcie prawnym wymagają usystematyzowania i wskazania tych problemów interpretacyjnych, które mają szczególne znaczenie w stosowaniu prawa zgodnie z jego przeznaczeniem i założeniem ustawodawcy.

The study deals with the legal and system conditions for determining a lower and reduced retirement age under current legal norms, taking into account the objectives behind the reform of the pension system and solutions aimed at mitigating the effects of this reform. Determining the appropriate retirement age in line with the legislator's assumptions gives applicants a guarantee of the correct application of the law. Numerous subsequent references included in the basic legal act for pensions require systematization and on indication of those interpretational problems that are of particular importance in the application of the law in accordance with its intended purpose and legislature assumptions.
