Comparative analysis of the legal position of the Ombudsman in Poland and the European Ombudsman

Rzecznik Praw Obywatelskich to instytucja niezwykle cenna w każdym państwie demokratycznym, a od kilkunastu lat również w Unii Europejskiej. Celem niniejszej pracy jest przedstawienie oraz porównanie pozycji prawnej instytucji ombudsmana w Polsce i Europejskiego Rzecznika Praw Obywatelskich.Praca składa się z czterech rozdziałów. Pierwszy rozdział poświęcony jest genezie instytucji ombudsmana oraz opisuje przebieg debat, których zwieńczeniem było utworzenie instytucji Rzecznika Praw Obywatelskich w Polsce oraz Europejskiego Rzecznika Praw Obywatelskich, odpowiednio w 1987 i 1992r. Rozdział drugi traktuje o pozycji prawnej Rzecznika Praw Obywatelskich w Polsce, którego zadaniem jest stanie na straży wolności i praw człowieka i obywatela. W tym rozdziale przedstawione zostały m.in regulacje prawne, które zapewniają Rzecznikowi niezależność przy wypełnianiu obowiązków. Opisane zostały także przesłanki, które muszą zostać spełnione, aby Rzecznik mógł podjąć działanie oraz przedstawiona została paleta środków, z których może skorzystać, gdy stwierdzi naruszenie wolności i praw. Rozdział trzeci poświęcony jest Europejskiemu Rzecznikowi Praw Obywatelskich, którego zadaniem jest ujawnianie przypadków niewłaściwego administrowania w działaniach instytucji, organów oraz jednostek Unii Europejskiej. Analogicznie jak to było w poprzednim rozdziale, przedstawione zostały sytuacje, w których Rzecznik podejmuje działania i środki, z których może skorzystać, jeśli stwierdzi że doszło do naruszenia zasad dobrej administracji.Z kolei rozdział czwarty stanowi podsumowanie całej pracy i zawiera kilka refleksji na temat obu instytucji.

Ombudsman is an extremely valuable institution in any democratic country and for several years also in the European Union. The aim of this thesis is to present and compare the legal position of the Ombudsman in Poland and the European Ombudsman.The thesis consists of four chapters. The first chapter is devoted to the origins of the institution of ombudsman and describes the course of the several debates, the culmination of which was establishment of the Ombudsman in Poland and the European Ombudsman, respectively in 1987 and 1992.The second chapter is about the legal position of the Ombudsman in Poland whose task is to safeguard the freedoms and rights of persons and citizens. Among other things, this section includes analysis of regulations which ensure the independence of the Ombudsman. It also describes the conditions which must be met before the Ombudsman can take action and presents the range of measures which he can take when an infringement of the freedoms and rights is found.The third chapter is devoted to the European Ombudsman whose task is to examine instances of maladministration in the activities of the European Union institutions, bodies and agencies. Just as it was in the previous chapter, it shows situations when the European Ombudsman takes action and describes all measures which may be used by the Ombudsman when he finds a violation of the principles of good administration. The fourth chapter provides a summary of the thesis and includes some reflections on both institutions.
