Competences of President of the Republic of Poland in terms of foreign policy on the basis of Polish constitutions in the years 1922-1997

Tematem pracy jest rola i kompetencje Prezydenta RP w polityce zagranicznej. Praca ma charakter przekrojowy, kompetencje Prezydenta w sferze spraw zagranicznych zostały przedstawione od pojawienia się tego urzędu w polskim systemie ustrojowym na gruncie Konstytucji marcowej w 1922 r. do chwili obecnej. Pierwszy rozdział dotyczy kompetencji Prezydenta w polityce zagranicznej na gruncie historycznych regulacji konstytucyjnych od Konstytucji marcowej do Małej Konstytucji z 1992 r. Drugi rozdział poświęcony jest roli i kompetencjom Prezydenta w polityce zagranicznej na gruncie obowiązującej Konstytucji RP z dnia 2 kwietnia 1997 r. Z kolei ostatni, trzeci rozdział poświęcony jest porównaniu kompetencji Prezydenta i Rady Ministrów w polityce zagranicznej oraz specyficznemu unormowaniu z art.133 ust.3 Konstytucji RP dotyczącego nakazu współdziałania w zakresie polityki zagranicznej skierowanego do Prezydenta, Prezesa Rady Ministrów, oraz ministra spraw zagranicznych. Ważnym elementem rozdziału jest także omówienie sporu kompetencyjnego pomiędzy Prezydentem a Prezesem Rady Ministrów rozstrzygniętego postanowieniem Trybunału Konstytucyjnego z dnia 20 maja 2009 r. Przedstawienie tematu w ujęciu historyczno-porównawczym pozwala na zaobserwowanie zmian w kompetencjach i roli Prezydenta w polityce zagranicznej na przestrzeni lat i kolejnych konstytucji.

The topic of the thesis is the role and competences of the President of the Republic of Poland in foreign policy. The work is of a cross-sectional nature, the President's competences in the sphere of foreign affairs have been presented since the appearance of this office in the Polish political system on the ground of the March Constitution in 1922 to the present. The first chapter concerns the President's competences in foreign policy under historical constitutional regulations from the March Constitution to the Small Constitution of 1992. The second chapter is dedicated to the role and competences of the President in foreign policy on the basis of the current Constitution of the Republic of Poland of 2 April 1997. The last, third chapter is dedicated to comparison the competences of the President and the Council of Ministers in foreign policy and a specific regulation of Article 133 sec. 3 of the Constitution of the Republic of Poland regarding the order of cooperation in the area of foreign policy addressed to the President, the Prime Minister and the foreign affairs minister. An important element of the chapter is also the circumlocution of the competence dispute between the President and the Prime Minister resolved by the decision of the Constitutional Tribunal of 20 May 2009. Presentation of the topic in historical and comparative perspective allows to observe changes in the competences and role of the President in foreign policy over the years and subsequent constitutions.
