The crime of offending religious feelings in the Polish legal tradition and other selected European countries

Tematem pracy jest szeroko pojęta kwestia obrazy uczuć religijnych w ujęciu prawa karnego na przestrzeni dziejów. Autor odnosi się do prawodawstwa polskiego na tle porównawczym z wybranymi krajami Europy. W pracy zdefiniowane zostały podstawowe pojęcia związane z tematem rozprawy. Scharakteryzowana została również geneza ochrony wolności religijnej oraz kształtowanie się na przestrzeni dziejów normatywnej ochrony wolności sumienia i wyznania. Analizie poddano również ustawodawstwo w Polsce i wybranych krajach europejskich pod kątem przyczyn powstania omawianych regulacji prawnych. Poza aspektem prawnym autor skupił się także na czynnikach społecznych i historycznych, które miały kluczowe znaczenie dla pierwszych kodyfikacji w zakresie tytułowego zagadnienia. Na kartach pracy autor przedstawił również badania z zakresu orzecznictwa sądowego związanego z omawianym tematem. Kolejnym elementem badań autora jest analiza współczesnych kodyfikacji karnych obowiązujących w poszczególnych krajach Europejskich. Zwieńczeniem rozprawy jest odniesienie się autora do planowanej nowelizacji polskiego kodeksu karnego jak również przedstawienie ewolucji zagadnienia zawartego w tezie.

The subject of the work is the widely understood issue of offending religious feelings in terms of criminal law throughout history. The author refers to Polish legislation on a comparative basis with selected European countries. The work defines the basic definitions related to the topic of the dissertation. The genesis of the protection of religious freedom and the development of normative protection of the freedom of conscience and religion throughout history have also been characterized. The legislation in Poland and selected European countries was also analyzed in terms of the reasons for the emergence of the discussed legal regulations. In addition to the legal aspect, the author also focused on social and historical factors that were of key importance for the first codifications of the title issue. On the worksheets, the author also presented research in the field of judicial decisions related to the discussed topic. Another element of the author's research is the analysis of contemporary penal codifications in force in individual European countries. The conclusion of the dissertation is the author's reference to the planned amendment to the Polish penal code as well as the presentation of the evolution of the issue contained in the thesis.
