The evolution of the electoral system to the Sejm of the Republic of Poland in the years 1989-2023

Przedmiotem niniejszej pracy jest całościowe i zupełne zebranie, usystematyzowanie oraz podsumowanie niemal 35-letniego procesu ewolucji systemu wyborczego do Sejmu Rzeczypospolitej Polskiej. Omawiając poszczególne ustawy, ich projekty oraz inne inicjatywy, autor prezentuje wynikowy charakter zmian, wskazując na przyczyny podjęcia prac nad kolejnymi nowelizacjami oraz analizuje ich przebieg. Linearny charakter pracy pozwala płynnie zaprezentować proces kształtowania się systemu wyborczego w Polsce, a także zaakcentować najważniejsze zmiany, jakie zaszły w nim na przestrzeni lat, wskazując na ich rozwój oraz fakt, że każdy kolejny projekt był rezultatem wcześniejszych doświadczeń i zmierzał do wyeliminowania negatywnych aspektów ustawy wyborczej, które ujawniały się w wyniku wyborów do Sejmu RP. Przyjęta przez autora metodologia badawcza wykorzystana w trakcie przygotowania pracy dyplomowej opierała się na analizie tekstu prawnego konstytucji, ustaw wyborczych, orzecznictwa i doktryny z tego zakresu, a także tekstów projektów ustaw i ich uzasadnień udostępnionych dzięki uprzejmości Kancelarii Sejmu oraz analizie szczegółowych danych wyborczych z wyborów 1991–2019, udostępnionych autorowi przez Krajowe Biuro Wyborcze. Wykorzystano również liczną literaturę przedmiotu, która umożliwiła opracowanie zagadnień ogólnoteoretycznych oraz stenogramy z posiedzeń Sejmu Polskiej Rzeczypospolitej Ludowej i Sejmu Rzeczypospolitej Polskiej, pozwalające w pełny i niebudzący wątpliwości sposób uchwycić ewolucyjny charakter zmian, a także zaprezentować założenia, które przyświecały parlamentarzystom w trakcie prac nad ordynacją wyborczą do Sejmu Rzeczypospolitej Polskiej.

The subject of this work is a comprehensive and complete collection, systematization and a summary of the 35-year process of evolution of the electoral system to the Sejm of the Republic of Poland. By discussing individual acts and their drafts, as well as other initiatives, the author presents the nature of the changes, indicates the reasons for the work on further amendments and analyses their course. The linear nature of the work allows for a smooth presentation of the process of forming the electoral system in Poland, as well as highlighting the most important changes that have taken place in this system over the years, with the aim of not only presenting its development but also pointing out the fact that each subsequent project was the result of previous experience that influenced the elimination of the negative aspects of the act that arose as a result of elections to the Sejm of the Republic of Poland. The methodology of the research presented by the author and used during the preparation of the diploma thesis was based on the analysis of the legal texts of the Constitutions, electoral laws and jurisprudence together with doctrine in this field, as well as texts of bills and their memoranda which were made available by the Chancellery of the Sejm; and the analysis of detailed electoral data from the elections 1991–2019 that was provided to the author by the National Electoral Office. In addition, an extensive literature on the subject was used, which allowed for the possibility to develop general theoretical questions; as well as transcripts from the sessions of the Sejm of the Polish People's Republic and the Sejm of the Republic of Poland, making it possible to fully and unambiguously capture the evolutionary nature of the changes and present the assumptions that guided the deputies over their work on the electoral law to the Sejm of the Republic of Poland.
