Removal of Trees and Shrubs. Analysis of Fees and Penalties as Financial Instruments for the Protection of Natural Resources.

Praca magisterska koncentruje się na analizie regulacji prawnych dotyczące opłat i kar pieniężnych za usuwanie drzew i krzewów, na gruncie ustawy z dnia 16 kwietnia 2004 r. o ochronie przyrody. Akty normatywne takie jak ustawa o ochronie przyrody, Konstytucja RP czy Kodeks cywilny wprowadzają regulacje mające na celu ochronę drzew i krzewów. Przepisy ustawy o ochronie przyrody regulują problematykę usuwania drzew i krzewów m.in poprzez niezbędne instrumenty regulacyjne usuwania drzew i krzewów, czyli opłaty i kary pieniężne. Celem pracy jest szczegółowa analiza tych regulacji, z uwzględnieniem poglądów doktryny i orzecznictwa sądów, które wpływają na praktykę stosowania przepisów.Praca składa się z czterech głównych rozdziałów:Rozdział pierwszy stanowi wprowadzenie do problematyki związanej z tematem niniejszej pracy, ma na celu wyjaśnienie kluczowych pojęć oraz przedstawienie problematyki z perspektywy różnych gałęzi prawa.W rozdziale drugim poddano analizie zmiany przepisów prawnych dotyczących opłat i kar za usuwanie drzew i krzewów oraz obowiązujących regulacji dotyczących m.in zezwoleń i obowiązku nasadzeń zastępczych.Rozdziały trzeci oraz czwarty to najważniejsze elementy pracy, gdyż wprost odnoszą się do tematu niniejszej pracy. Rozdziały te regulują przepisy o opłatach i karach pieniężnych za usuwanie drzew i krzewów Opisują m.in wymiar zarówno opłat jak i kar, sposoby ich ustalania, podmioty, na których nakłada się kary czy też aspekty temporalne opłat i kar pieniężnych. W zakończeniu pracy przedstawiono weryfikację celów oraz ogólne podsumowanie rozważań, a także propozycje zmian przepisów mających na celu lepszą ochronę drzew i krzewów.

The master's thesis focuses on the analysis of legal regulations concerning fees and penalties for the removal of trees and shrubs, based on the Act of April 16, 2004, on Nature Conservation. Normative acts such as the Nature Conservation Act, the Constitution of the Republic of Poland, and the Civil Code introduce regulations aimed at the protection of trees and shrubs. The provisions of the Nature Conservation Act regulate the issue of tree and shrub removal, among other things, through the necessary regulatory instruments for tree and shrub removal, namely fees and penalties.The aim of the thesis is a detailed analysis of these regulations, taking into account the views of legal doctrine and court rulings that influence the practice of applying these provisions.The thesis consists of four main chapters:The first chapter serves as an introduction to the issues related to the topic of this thesis. It aims to explain key concepts and present the issues from the perspective of various branches of law.The second chapter analyzes the changes in legal provisions concerning fees and penalties for the removal of trees and shrubs, as well as the current regulations regarding, among others, permits and the obligation of replacement plantings.The third and fourth chapters are the most important parts of the thesis, as they directly relate to the topic of this thesis. These chapters regulate the provisions on fees and penalties for the removal of trees and shrubs. They describe, among other things, the amount of both fees and penalties, the methods of their determination, the entities on which penalties are imposed, and the temporal aspects of fees and penalties.In the conclusion of the thesis, the verification of the objectives and a general summary of the considerations are presented, as well as proposals for changes in the regulations aimed at better protection of trees and shrubs.
