The course of evidence proceedings in civil proceedings

Przedmiotem niniejszej pracy magisterskiej jest przedstawienie przebiegu postępowania dowodowego w postępowaniu cywilnym. W tym celu, ukazany jest szereg najważniejszych zasad obowiązujących w postępowaniu dowodowym. Jedną z kluczowych funkcji pracy jest dynamiczne, oraz precyzyjne przedstawienie przebiegu postępowania z jasno wyznaczonymi granicami czasowymi. Praca ta została zawężona do przebiegu postępowania dowodowego, jednakże została zwrócona uwaga na specyfikę postępowania dowodowego odnoszącego się do poszczególnych środków dowodowych, w szczególności do dowodu z dokumentu oraz dowodu z zeznań świadka. W pracy prezentowane są zmiany wynikające z nowelizacji Kodeksu postępowania cywilnego z 4 lipca 2019 r. Kluczowe więc jest wykazanie zmian jakie nastąpiły w przebiegu postępowania. Zostały poddane analizie liczne wyroki sądów celem określenia wad i zalet wprowadzonych przepisów. Opierając się na wyrokach autor przedstawił własne spostrzeżenia, co do zasadności wprowadzonych zmian w zakresie postępowania dowodowego.

1040/5000The subject of this thesis is to present the course of evidence in civil proceedings. For this purpose, a number of the most important rules applicable in the taking of evidence are presented. One of the key functions of work is the dynamic and precise presentation of the course of proceedings with clearly defined time limits. This work has been limited to the course of the taking of evidence, however, attention has been paid to the specificity of the taking of evidence relating to individual means of evidence, in particular to documentary evidence and evidence from witness testimony. The paper presents the changes resulting from the amendment to the Code of Civil Procedure of July 4, 2019. It is therefore crucial to demonstrate the changes that have occurred in the course of the proceedings. Numerous court judgments have been analyzed in order to determine the advantages and disadvantages of the introduced provisions. Based on the judgments, the author presented his own observations as to the legitimacy of the introduced changes in the scope of evidentiary proceedings.
