Theft while using a self-service checkout in a store

W artykule poddano analizie zagadnienie kwalifikacji prawnej postępowania klienta sklepu, który zabiera konkretną rzecz ruchomą bez uiszczenia za nią stosownej zapłaty, wykorzystując kasę samoobsługową, na której rejestruje fikcyjną transakcję zakupu innego towaru. Wykazano, że omawiane zachowanie nie wyczerpuje znamion oszustwa stypizowanego w art. 286 § 1 Kodeksu karnego, lecz stanowi bezprawny zabór cudzej rzeczy ruchomej w celu jej przywłaszczenia, wyczerpujący znamiona kradzieży przestępnej (art. 278 § 1 Kodeksu karnego) lub wykroczeniowej (art. 119 § 1 Kodeksu wykroczeń).

The article presents an analysis of the legal qualification of the conduct of a store’s customer who takes specific goods without paying, using the self-service checkout to register a fictitious transaction of purchasing another product. It is shown that this act is not classified as fraud under Article 286 §1 of the Polish Penal Code, but constitutes the unlawful seizure of a third party’s property for the purpose of alienation and therefore constitutes criminal theft (Article 278 § 1 of the Polish Penal Code) or a theft as a misdemeanour (Article 119 § 1 of the Polish Code of Misdemeanours).
