Authenticity and integrity of monuments under the law in force in Poland

W artykule dokonano analizy aktów prawa międzynarodowego i polskiego - źródeł prawa powszechnie obowiązującego w Polsce pod kątem uregulowań dotyczących ochrony autentyczności i integralności zabytków. Przeanalizowano akty prawne, których wykładania daje podstawę do przyjęcia ochrony autentyczności i integralności zabytków zarówno sensu stricto, jak i sensu largo. Ponadto sformułowano uwagi de lege lata i de lege ferenda w odniesieniu do kwestii ochrony autentyczności i integralności zabytków w źródłach prawa powszechnie obowiązującego w Polsce, a także przeanalizowano relację definicyjną pomiędzy ochroną zabytków i ochroną ich autentyczności, a także integralności.

The article analyzes of international and Polish legal acts - sources of the law in force in Poland from the point of view of regulations connected with protection of authenticity and integrity of monuments. There were analyzed those legal acts, based on which the protection of authenticity and integrity of cultural goods can be sensu stricto and sensu largo interpreted. Moreover the de lege lata remarks and the de lege ferenda remarks refered to topics of protection of authenticity and integrity of monuments in sources of the law in force in Poland were formulated. The definition relation between protection of monuments and protection of its authenticity and integrity was discussed too.
