Factors limiting the effectiveness of regulation anti-mobbing in Poland

Przedmiotem pracy są czynniki ograniczające skuteczność regulacji mających na celu zwalczać mobbing w Polsce oraz zapobiegać temu zjawisku. Mobbing jest przejawem patologii, która może wystąpić na gruncie relacji pracowniczych. Charakteryzuje się długotrwałymi i uporczywymi działaniami sprawcy, które polegają na nękaniu lub zastraszaniu ofiary. Czyny spełniające znamiona kodeksowej definicji mobbingu powodują u dotkniętego nimi pracownika wystąpienie dolegliwości psychicznych i fizycznych. W pracy przedstawiono podstawowe zagadnienia dotyczące mobbingu, tj. definicje, rodzaje, fazy, przyczyny wystąpienia omawianego zjawiska oraz jego skutki. Zaprezentowane zostały także prawne aspekty mobbingu. W ostatniej części pracy przedstawiono zagadnienie dotyczące skuteczności regulacji prawnych dotyczących mobbingu, które obowiązują w Polsce. Omówione zostały czynniki obniżające efektywność prawa traktującego o kwestii mobbingu. Główne z nich można odnaleźć w konstrukcji prawa, nieodpowiednim przygotowaniu instytucji właściwych w kwestiach zaprezentowanego zagadnienia oraz indywidualnych predyspozycjach ofiary i sprawcy mobbingu.
