Formal control of the application for initiation of proceedings

Praca ma na celu przedstawić procedurę wszczęcia postępowania i kontrolę wniosku o wszczęcie postępowania. Opisane są ogólne definicje podania i wniosku o wszczęcie postępowania oraz czym charakteryzuje się postępowanie jurysdykcyjne. W pracy została również zawarta charakterystyka czynności podejmowanych przez organ w ramach formalnej kontroli wniesienia wniosku o wszczęcie postępowania (przede wszystkim co bada organ administracji publicznej, czy spełnione są wymagania stawiane podaniom oraz właściwość organu). Przedstawiona została również dyskusja występująca w literaturze i orzecznictwie na temat tego w jakiej formie powinno nastąpić pozostawienie podania bez rozpoznania czyli konsekwencje procesowe stwierdzenia nieprawidłowości formalnych wniosku o wszczęcie postępowania.

The aim of the work is to present the procedure of initiation of proceedings and control of the application for initiation of proceedings. General definitions of the application and motion to initiate proceedings are described, and what characterizes jurisdictional proceedings. The work also contains a description of the activities undertaken by the authority as part of the formal control of the submission of an application to initiate proceedings (first of all, which is examined by a public administration authority, whether the requirements for applications and the authority of the authority are met). There was also a discussion in the literature and case-law on the form in which the application should be left without examination, i.e. the procedural consequences of finding formal irregularities in the application to initiate proceedings.
