dc.abstract.enThe thesis discusses the interface between the intellectual property right and private international law in case of online infringement. The first question which arises in the case of any infringement is the question of jurisdiction followed by the question of the applicable law. The topic is of extreme importance because the evolution of internet has changed the traditional form of infringement. Before the emergence of internet, the infringement was generally limited to the territorial boundary of one state. In the case of online infringement, the infringement takes place simultaneously in different member states.The paper analyses the existing law on the international jurisdiction and applicable law in EU and also analyses the application of the existing provisions to the cases of online infringement. The paper tries to identify the existing problems and tries to provide the effective solution. The paper also analyses the solution provided by the legal scholars in Principles on Conflict of Laws in Intellectual Property (CLIP Principles) drafted specifically to address the issue of private international in case of intellectual property right infringement.
