The origin and creation of the office of the Ombudsman in Poland

Celem niniejszej pracy jest przybliżenie genezy i okoliczności powstania urzędu Rzecznika Praw Obywatelskich (RPO) w Polsce, instytucji z założenia demokratycznej, która powstała w państwie z definicji antydemokratycznym. Omawiam ruchy społeczne oraz inicjatywy z czasów PRL zmierzające do odzyskania przez obywateli pełni praw, wydarzenia poprzedzające wprowadzenie stanu wojennego w 1981 r. W pracy poruszam kolejno tło historyczne i okoliczności poprzedzające uchwalenie ustawy o RPO oraz powołanie Prof. Ewy Łętowskiej na stanowisko Rzecznika pierwszej kadencji. Przedstawiam pierwsze prace i interwencje, początkową strukturę urzędu oraz specyfikę pracy w oparciu o pierwsze sprawozdanie RPO.

The purpose of this work is to explain the origins and circumstances of the establishment of the office of the Ombudsman in Poland, a democratic institution that was established in the country by definition as anti-democratic. I discuss social movements and initiatives from the times of the Polish People's Republic aimed at regaining full rights by citizens, events preceding the imposition of martial law in 1981. In my work, I turn on the historical background and circumstances preceding the adoption of the Act on RPO and the appointment of Prof. Ewa Łętowska for the position of Ombudsman of the first term. I present the first works and interventions, the initial structure of the office and the specificity of work based on the first ROP report.
