Tekst dotyczy problemów, jakie stwarza wykładnia art. 1047 kodeksu postępowania cywilnego. W przepisie tym określone zostały skutki wydania orzeczenia, którym sąd zobowiązuje pozwanego do złożenia oświadczenia woli określonej treści. Wynika z niego, że prawomocne orzeczenie sądu zobowiązujące do złożenia oświadczenia woli zastępuje to oświadczenie. Odwołania się do tego rodzaju fikcji prawnej nie rozwiązuje wszystkich problemów, jakie powstają przy próbach odpowiedzi na pytanie o konsekwencje zobowiązania pozwanego do złożenia oświadczenia woli.

The paper focuses on the issues in respect of the interpretation of art. 1047 of the Code of Civil Procedure. The provision defines the consequences of issuing a judgment in which the court obligates the defendant to make a statement of will with a specific content. It follows from the article that a final and binding court judgment which obligates a party to make a statement of will supersedes the statement. Invoking this type of legal fiction does not solve all the problems that are created while trying to answer the question as to the consequences of the defendant’s obligation to make a statement of will.
