System of dealing with minors in Poland

Temat pracy dotyczy systemu postępowania w sprawach nieletnich w Polsce. Praca oparta jest przede wszystkim na ustawie z dnia 26 października 1982 r. o postępowaniu w sprawach nieletnich oraz na artykule 10 kodeksu karnego z dnia 6 czerwca 1997 r. W pracy przedstawiłam teoretyczne modele postępowania wobec nieletnich. Następnie scharakteryzowałam pojęcie nieletniego oraz przedstawiłam środki możliwe do zastosowania wobec nieletnich oraz względem osób sprawujących nad nimi opiekę. Kolejno omówiłam ustawę o postępowaniu w sprawach nieletnich z dnia 26 października 1982 roku w jej pierwotnej wersji. Następnie przybliżyłam dwa najważniejsze projekty zmian omawianej ustawy, ze wskazaniem pozytywów i negatywów proponowanych rozwiązań. Na koniec omawianym przeze mnie zagadnieniem jest model postępowania w sprawach nieletnich na podstawie obecnej ustawy o postępowaniu w sprawach nieletnich, z uwzględnieniem ostatnich, istotnych nowelizacji.

The subject matter of the paper concerns the system of proceedings in juvenile cases in Poland. The work is based primarily on the Act of 26 October 1982 on the procedure in juvenile cases and on Article 10 of the Criminal Code of 6 June 1997. In my paper I presented theoretical models of dealing with minors. Then I characterised the concept of minors and described the measures that can be applied to minors and to those who care for them. I then discussed the Act on the Proceedings in Juvenile Matters of 26 October 1982 in its original version. Next, I presented two most important draft amendments to the Act, indicating the pros and cons of the proposed solutions. Finally, I discussed the model of juvenile justice on the basis of the current Act on juvenile justice, taking into account recent and significant amendments.
