Sham as a defect of the declaration of will

Celem niniejszej pracy jest analiza problematyki pozorności jako wady oświadczenia woli na gruncie art. 83 polskiego Kodeksu cywilnego. Omówione zostało pojęcie oświadczenia woli, a także scharakteryzowane zostały poszczególne wady oświadczenia woli. Analizie została poddana sama konstrukcja pozorności, jak również przesłanki konieczne do stwierdzenia jej ważności. Niezwykle ważnym elementem pracy jest funkcja ochronna, która wiąże się z sankcją nieważności. Pojęcie osoby trzeciej także zostało poddane próbie definicji, w dodatku omówiona została kwestia złej wiary osoby trzeciej. Aby łatwiej zobrazować i zrozumieć problem przedstawiono jeden z częstszych przykładów pozorności - małżeństwo pozorne.

The aim of this thesis is to analyze the issue of sham as a defect of the declaration of will on the strength of art. 83 of Polish Civil Code. The notion of a declaration of will has been discussed, and particular defects of a declaration of will have been characterized. The structure of the sham, as well as the prerequisites necessary to establish its validity, were analyzed. An extremely important element of the thesis is the protective function, which is associated with the sanction of nullity. The concept of a third party has been defined and the issue of bad faith of a third party has been discussed. In order to illustrate and understand the problem more easily, one of the most frequent examples of sham is presented - sham marriage.
