Imprisonment of pregnant women, during the puerperium and mother with children and international public law

Niniejsza praca dotyczy tematyki pozbawienia wolności kobiety w ciąży, w trakcie połogu i matki z dzieckiem w świetle prawa międzynarodowego publicznego. Poruszone zostały zagadnienia ogólne, przede wszystkim analiza problematyki pod kątem psychologicznym i socjologicznym. Przedstawiono wyniki badań przeprowadzonych w jednostkach przy zakładach karnych (gdzie przebywały kobiety ciężarne lub matki z dziećmi). Zestawiono również standardy odbywania kary pozbawienia wolności przez kobiety w ciąży, w trakcie połogu i matki z dzieckiem w wybranych państwach na świecie. W dalszej części pracy omówione zostały normy z zakresu tzw. prawa miękkiego. Podjęto próbę odpowiedzi na pytanie, w jakim stopniu Europejski Trybunał Praw Człowieka bierze pod uwagę soft law przy orzekaniu. Ponadto dokonano analizy wybranych niewiążących aktów prawnych dotyczących pozbawienia wolności kobiety w ciąży, w trakcie połogu i matki z dzieckiem. W trzecim rozdziale natomiast omówiono wybrane akty prawa wiążącego w odniesieniu do głównej tematyki niniejszej pracy oraz dokonano analizy trzech wybranych orzeczeń Europejskiego Trybunału Praw Człowieka w zakresie naruszeń w stosunku do kobiet ciężarnych, w trakcie połogu i matek z dziećmi pozbawionych wolności. Całość wywodu zwieńczona została próbą opracowania przykładowych, uniwersalnych reguł odbywania kary pozbawienia wolności przez kobiety ciężarne, kobiety w trakcie połogu i matki z dzieckiem, które to mogłyby stać się podstawą do przyjęcia umowy międzynarodowej w tym zakresie.

Imprisonment of a pregnant woman, during the puerperium and mother with a child in international public law is the main subject this MA thesis. The initial part is an analysis of the general issues in terms of psychology and sociology. The paper presents results of research carried out in units at prisons (where pregnant women or mothers with children were detained). Moreover the author complied standards of serving a sentence of imprisonment by pregnant women, women during the puerperium and mothers with children in selected countries around the world.In the further part of the thesis paper, there is an analysis of soft law standards. Furthermore the role of soft law in adjudicating of the European Court of Human Rights was considered. The author discussed selected non-binding legal acts concerning imprisonment of a pregnant woman, during the puerperium and of a mother with a child.The third chapter discussed selected acts of binding law in relation to the main subject of this thesis paper and analyzes three selected judgments of the European Court of Human Rights in the field of violations in relation to detained pregnant women, women during the puerperium or mothers with children.Thesis has been summarized with an attempt to develop exemplary, universal rules for serving a sentence of imprisonment by pregnant women, women during childbirth or mothers with a child, which could become the basis for the adoption of an international agreement.
