Enforcement against immovable property

Niniejsze opracowanie zawiera analizę najważniejszych zagadnień z zakresu postępowania egzekucyjnego i egzekucji z nieruchomości. Rozdział 1 został poświęcony omówieniu rysu historycznego rozwoju egzekucji z nieruchomości w Polsce oraz zagadnień związanych z wzajemnymi relacjami postępowania egzekucyjnego, postępowania rozpoznawczego i postępowania zabezpieczającego. W rozdziale 2 scharakteryzowano podstawę postępowania egzekucyjnego, a w szczególności kwestie dotyczące tytułu wykonawczego i klauzuli wykonalności. Ponadto został w nim omówiony przedmiot postępowania egzekucyjnego i przedmiot zwykłej i uproszczonej egzekucji z nieruchomości. W rozdziale 3 została przedstawiona ogólna charakterystyka podmiotów występujących w postępowaniu egzekucyjnym, tj. komornika, sądu i uczestników postępowania egzekucyjnego. Ostatni rozdział pracy dotyczy problematyki wszczęcia postępowania i dalszych czynności egzekucyjnych prowadzonych w jego ramach. W kończącym niniejszą pracę podsumowaniu podjęto próbę dokonania oceny obowiązujących regulacji w zakresie sądowej egzekucji z nieruchomości oraz sformułowania postulatów pod adresem ustawodawcy.

This paper contains an analysis of the most important issues from the field of enforcement proceeding and enforcement against immovable property. Chapter 1 describes the issues connected with types of procedures connected with enforcement regulations. Additionally, a short historical view of enforcement against immovable property in Poland has been presented in this chapter. Chapter 2 includes the basis of enforcement procedure and the issues linked with enforceable title and enforcement clause. Moreover, it describes in detail the enforcement proceeding, as well as the subject of ordinary and simplified enforcement against immovable property. In Chapter 3, a general characteristic of the participants and organs (the court and the court enforcement officer) of enforcement proceeding has been presented. The last chapter concerns initiation of the proceeding and further enforcement activities. In the summary concluding this paper, an attempt was made to assess the applicable regulations in the field of judicial enforcement against immovable property and to formulate demands for the legislator.
