Maintenance obligations in Polish-British relations : Brexit and what next?

Celem tego artykułu jest ukazanie możliwych zmian w zakresie transgranicznych alimentów w obliczu brexitu. Z polskiej perspektywy temat ma szczególne znaczenie społeczne ze względu na liczną migrację zarobkową Polaków do Wielkiej Brytanii. Szacuje się, że w Wielkiej Brytanii mieszka około miliona Polaków. Umowa o wystąpieniu UK z UE utrzymała obowiązywanie w zakresie alimentów rozporządzenia nr 4/2009 w relacjach Polski z Wielką Brytanią do czasu zakończenia okresu przejściowego. Okres przejściowy upływa z końcem 2020 r., jednak moim zdaniem jest bardzo realne jego przedłużenia, biorąc pod uwagę, że nie tylko UE, ale cały świat zmaga się aktualnie z pandemią COVID-19. Jest wysoce prawdopodobne, że po zakończeniu okresu przejściowego Wielka Brytania przystąpi do konwencji haskiej z 2007 r. o międzynarodowym dochodzeniu alimentów na rzecz dzieci i innych członków rodziny oraz do konwencji lugańskiej z 2007 r. o jurysdykcji i uznawaniu oraz wykonywaniu orzeczeń sądowych w sprawach cywilnych i handlowych. Jest to tym bardziej realne, że zawarcie dwustronnej umowy polsko-brytyjskiej w zakresie alimentów nie jest możliwe z uwagi na brak kompetencji państw członkowskich do zawieranie takich umów z państwami trzecimi, jakim stało się Wielka Brytania na skutek brexitu.

The purpose of this article is to show possible changes in cross-border maintenance in the face of Brexit. From a Polish perspective, the topic is of particular social importance due to the numerous labor migration of Poles to Great Britain. It is estimated that around one million Poles live in Great Britain. The Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community maintained Regulation No. 4/2009 of 18 December 2008 on jurisdiction, applicable law, recognition and enforcement of decisions and cooperation in matters relating to maintenance obligations in force the field of maintenance in Poland's relations with the United Kingdom until the end of the transition period. The transition period ends at the end of 2020, but in my opinion an extension is very real, given that the entire world is currently struggling with the COVID-19 pandemic. It is highly likely that aft er the end of the transition period, the United Kingdom will accede to the 2007 Hague Convention on the International Recovery of Child Support and Other Forms of Family Maintenance and the 2007 Lugano Convention on Jurisdiction and the Recognition and Enforcement of Judgments in Civil and Commercial Matters. It is all the more real as the conclusion of a bilateral Polish-British agreement on alimony is not possible due to the lack of competence of member states to conclude such agreements with third countries, such as Great Britain has become as a result of Brexit.
