Supervision of churches and religious associations in Poland from 1918 to 1989

Tematyka związana z relacjami między państwem a Kościołem jest bardzo skomplikowana, jest przedmiotem zainteresowań i rozważań wielu dyscyplin naukowych. Problematykę dotyczącą nadzoru wojewody nad kościołami i innymi związkami wyznaniowymi w okresie międzywojennym można analizować na podstawie relacji powstawania, różnorodnych modeli regulacji stosunków między Kościołem, a państwem na płaszczyźnie prawnej oraz metod ich realizacji w praktyce. Polityka i religia są to odmiennie przejawiające się aktywności ludzkie, natomiast Kościół i Państwo to społeczności o charakterze odmiennej natury, które niełatwo jest od siebie w całości rozgraniczyć. Przedkłada to natura społeczności i przeżyć z jakimi zeszło jej się zmagać, podobnie jak doświadczenia historyczne, jakich nanoszą dzieje tych koneksji. W celu precyzyjnej oceny i nakreślenia problematyki tematu mojej pracy przedstawię dwa rozdziały na poziomie wielopłaszyznowym pod względem teoretycznym oraz w ujęciu praktycznego wymiaru w relacjach państwo-Kościół w okresie II Rzeczpospolitej. Analogicznie zostanie poruszona charakterystyka systemów, a także roli nadzoru między działalnością wojewody relacjonując stosunki oraz ukazując stanowisko Kościoła i innych związków wyznaniowych. Pierwszy rozdział nosi tytuł: ,,Nadzór wojewody nad Kościołami i związkami religijnymi w II RP (1918- 1939)’’, natomiast drugi to: ,,Praktyczny wymiar relacji państwo-kościół w II RP. wybrane przykłady’’ – tematy zostaną zrelacjonowane na podstawie źródła prawa polskiego i katolickiego. W drodze pewnej retrospekcji sformułowane zostaną systemy nadzoru i kontroli wojewody, zasady oraz role funkcji jakimi kierują się władze państwowe z wyszczególnieniem stanowiska wojewody w swej polityce wyznaniowej, oraz norm, prawnych i metod ich realizacji w życiu społecznym, uwzględniając stosunek społeczeństwa do religii i Kościoła. Poszukując odpowiedzi na fundamentalne pytania dotyczące głównych zagadnień prawnych funkcji państwa, a Kościoła oraz związków wyznaniowych, swoją pracę opierać będę między innymi na podstawię książki Michała Pietrzaka pt. ,,Prawo wyznaniowe”, ustawie z dnia 17 marca 1921 r oraz różnego rodzaju publikacjach. Każde przyjmowane założenie dotyczące problematyki omawianego tematu znajdzie swoje odzwierciedlenie w prowadzonej przez Państwo polityce wyznaniowej, decydując o treści przykładowo obowiązujących norm, które potwierdzę w oparciu o założenia na podstawie adekwatnych kryteriów i założeń czasów II RP (1918 do 1939). Jestem przekonana, iż zaprezentowane w pracy teksty ułatwią zrozumienie specyfiki nadzoru wojewody nad Kościołem katolickim i innymi kościołami i związkami wyznaniowymi w Polsce w latach 1918 r. do 1939 r. Sięgając dziś pamięcią do tego historycznego okresu, kiedy po latach politycznej niewoli kształtowała się państwowość polska. Wybrany przeze mnie temat nawiązuje do szczególnego okresu w dziejach społeczeństwa polskiego, czyli okresu międzywojennego, który kreował się kuriozalnie w przeszłości aktywnością państwowotwórczą wszystkich grup społecznych.

The issues related to the relations between the state and the Church are very complicated, they are the subject of interests and considerations of many scientific disciplines. The issues related to the governor's supervision over churches and other religious associations in the interwar period can be analyzed on the basis of the relationship of formation, various models of regulating relations between the Church and the state on the legal level and methods of their implementation in practice. Politics and religion are different human activities, while the Church and the State are communities of a different nature that are not easy to separate from each other. This is put forward by the nature of the community and the experiences it has had to deal with, as well as by the historical experiences that the history of these connections imposes. In order to precisely assess and outline the topic of my work, I will present two chapters at the multi-faceted level in terms of theoretical and practical dimensions in the relations between the state and the Church during the Second Polish Republic. The characteristics of the systems as well as the role of supervision between the activities of the voivode will be discussed in a similar way, reporting on the relations and showing the position of the Church and other religious associations.The first chapter is entitled: "Governor's supervision over Churches and religious associations in the Second Polish Republic (1918-1939)", while the second is: "The practical dimension of the state-church relationship in the Second Polish Republic. selected examples '' - topics will be reported on the basis of the source of Polish and Catholic law. In the course of a certain retrospection, the voivode's supervisory and control systems will be formulated, as well as the rules and roles of the functions of the state authorities, with the specification of the voivode's position in their denominational policy, as well as the legal norms and methods of their implementation in social life, taking into account the attitude of society to religion and the Church. While searching for answers to fundamental questions concerning the main legal issues of the functions of the state, the Church and religious associations, I will base my work on the basis of the book by Michał Pietrzak entitled "Religious Law", the Act of March 17, 1921 and various publications. Each adopted assumption regarding the subject matter of the discussed topic will be reflected in the religious policy conducted by the state, deciding on the content of, for example, applicable norms, which I will confirm based on assumptions based on adequate criteria and assumptions of the times of the Second Polish Republic (1918 to 1939).I am convinced that the texts presented in the work will make it easier to understand the specificity of the governor's supervision over the Catholic Church and other churches and religious associations in Poland in the years 1918 to 1939. Today, going back to that historical period, when Polish statehood was taking shape after years of political captivity . The topic I chose refers to a special period in the history of Polish society, i.e. the interwar period, which was created curiously in the past by the state-creating activity of all social groups.
