Public orders in open tender proceeding.

W przedmiotowej pracy przedstawiony został przykład zamówienia publicznego w trybie przetargu nieograniczonego. Omówione i zdefiniowane zostały ogólne pojęcia. Scharakteryzowano zamawiającego i wykonawcę. W dalszej części zasady i tryby udzielania zamówień publicznych. Zaprezentowane zostały wszystkie informacje, które obligatoryjnie powinny znaleźć się w ogłoszeniu i specyfikacji zgodnie z nałożonym obowiązkiem na zamawiającego przez ustawodawcę.W rozpatrywanym przetargu nieograniczonym zamawiający w sposób świadomy ograniczył zasadę konkurencyjności i osiągnął zamierzony cel. Przeanalizowano dogłębnie całą procedurę przetargową pod względem zgodności z Ustawą z dnia 29 stycznia 2004 r. prawo zamówień publicznych.

The thesis presents the subject of an open tender through an analysis of one example of thereof. The key notions were discussed and defined, and the ordering party and the contractor characterized. Further on, the rules and modes of the tending procedure were analyzed. Also, all information which are mandatorily to be included in the public tender announcement, and specifications as per the obligations imposed on the ordering party by the legislator were presented. In the examined case of open tender the ordering party deliberately restricted the rule of competitiveness and achieved the intended objective.The whole tending procedure was carefully examined with regard to its conformity to the Public Tending Act of January 29, 2004.
