Legal language and language of the law at the turn of centuries (research perspectives and threats)

Po zdefiniowaniu pojęć: język prawny i język prawniczy oraz ocenie przydatności tekstów prawnych i prawniczych do badań językoznawczych, w artykule skupiono się na analizie tekstów prawniczych tworzonych na przełomie wieków i starano się ustalić przyczyny ich niezrozumiałości. Zaliczono do nich: strukturę tekstu (brak wyraźnego podziału treści), homonimię składniową, wtórne związki składniowe, niepoprawne konstrukcje z imiesłowowymi równoważnikami zdań, brukselizmy i zbędne zapożyczenia, a także niepoprawną interpunkcję. Pokazano też konsekwencje semantyczne oraz skutki prawne wynikające z nieodmieniania nazwisk w tekstach prawniczych.

After defining the notions: legal language and language of the law, and after evaluating the usefulness of legal and law texts in linguistic research, the author of the article focuses on analysing legal texts written at the turn of the centuries and tries to determine the reasons why the texts are incomprehensible. Such reasons include: the structure of the text (the lack of clear division of the content), syntax homonymy, derivative syntactic relations, incorrect structures containing elliptical sentences, Brussels bureaucratic vocabulary and unnecessary borrowings, as well as incorrect punctuation. Also, the author shows semantic and legal consequences resulting from the fact that surnames are not declined in legal texts.
