Administrative Judiciary in the Duchy of Warsaw

Niniejsza praca magisterska ma na celu przedstawienie sądownictwa administracyjnego w Księstwie Warszawskim. W pierwszym rozdziale została opisana historia powstania Księstwa Warszawskiego oraz jego ustrój konstytucyjny. W kolejnych podrozdziałach pierwszego rozdziału opisane zostały tradycje polskiego i francuskiego sądownictwa administracyjnego. Zawarty został opis organów sądowych i administracyjno-sądowych funkcjonujących w I-szej Rzeczypospolitej oraz XVIII-wieczne organy francuskiego sądownictwa administracyjnego. W drugim rozdziale opisano podział oraz administrację terytorialną Księstwa Warszawskiego, a także rady prefekturalne, czyli sądy administracyjne I instancji w Księstwie Warszawskim, historię ich powstania, sposób postępowania, a także ich losy po upadku Księstwa Warszawskiego. Trzeci rozdział został poświęcony Radzie Stanu i opisana została historia jej powstania, a także jej uprawnienia jako sądu II instancji oraz jako Sądu Kasacyjnego w Księstwie Warszawskim.

This master's thesis aims to present the administrative judiciary in the Duchy of Warsaw. The first chapter describes the history of the creation of the Duchy of Warsaw and its constitutional system. The following subchapters of the first chapter describe the traditions of Polish and French administrative courts. It includes a description of the judicial and administrative-judicial bodies functioning in the First Polish Republic as well as the 18th-century bodies of the French judiciary. The second chapter describes the division and territorial administration of the Duchy of Warsaw, as well as the prefectural councils, i.e. administrative courts of the first instance in the Duchy of Warsaw, the history of their creation, method of conduct, and their fate after the fall of the Duchy of Warsaw. The third chapter was devoted to the Council of State and described the history of its creation, as well as its powers as a court of second instance and as the Court of Cassation in the Duchy of Warsaw.
