Restitution of expropriated property

Przedmiotem niniejszej pracy jest zwrot wywłaszczonej nieruchomości. Instytucja wywłaszczenia nieruchomości oraz zwrotu wywłaszczonej nieruchomości została uregulowana w ustawie o gospodarce nieruchomościami. Celem pracy jest przybliżenie instytucji wywłaszczenia nieruchomości oraz jej zwrotu osobie zainteresowanej w świetle wspomnianej ustawy. Oba procesy stanowią istotne zagadnienie prawne, pociągające za sobą wiele konsekwencji, zarówno społecznych, jak i ekonomicznych. W pierwszej kolejności opisana została instytucja wywłaszczenia nieruchomości, która stanowi prawnie uzasadnioną ingerencję podmiotów prawa publicznego w prawa jednostki. Dalsza część pracy odnosi się do kwestii słusznego odszkodowania za wywłaszczoną nieruchomość wypłacanego osobie wywłaszczonej. Ostatni rozdział dotyczy instytucji zwrotu wywłaszczonej nieruchomości, która stanowi uprawnienie poprzedniego właściciela nieruchomości lub jego spadkobiercy do ubiegania się o zwrot wywłaszczonej mu nieruchomości. Nieodłącznym elementem łączącym obie te procedury jest realizacja celu publicznego na wywłaszczonej nieruchomości. W świetle przeprowadzonej analizy istotne staje się znalezienie pewnego rodzaju równowagi pomiędzy interesem publicznym a prywatnym prawem własności.

The subject of this thesis is the return of expropriated real estate. The institution of expropriation of real estate and the return of expropriated real estate are regulated by the Real Estate Management Act. The purpose of this work is to familiarize with the institution of expropriation of real property and its return to the person concerned in light of the said Act. Both processes constitute an important legal issue with many consequences, both social and economic. The first part of the work describes the institution of expropriation of immovable property, which constitutes a legally justified interference of public law entities with the rights of an individual. The next part of the work addresses the issue of just compensation for expropriation of real estate, which is paid to the expropriated person. The final chapter deals with the procedure for the return of expropriated property, which is the entitlement of the previous owner of the property or his heir to seek the return of the property expropriated from him. The inherent link between the two procedures is the realization of a public purpose for the expropriated property. In light of the analysis carried out, it becomes important to find some kind of balance between the public interest and private property rights.
