Praca zwiera szczegółową charakterystykę kwestii prejudycjalnej jako jednej z przesłanek zawieszenia postępowania administracyjnego. Początkowe rozważania dotyczą zasady ciągłości postępowania administracyjnego, a następnie instytucji zawieszenia postępowania jako wyjątku od wspomnianej wyżej zasady. Omówienie problematyki zawieszenia postępowania stanowi wstęp do analizy zagadnienia wstępnego. Charakterystyka kwestii prejudycjalnej dokonana jest w oparciu o cztery elementy, których łączne wystąpienie jest niezbędne do uznania danej kwestii za prejudykat. Teoretyczne wywody zostały poparte przykładami z orzeczeń sądów administracyjnych.
The thesis relates to prejudical issue, one of the premise of stay of administrative proceeding. The initial scrutiny involves the principle of continuity of proceeding then an institution of the stay of the administrative proceeding as anexeption of the former principle. The treatment of the issues is known to be the opening of an analisis of the preliminary question. Moreover the characteristics of the prejudical issue has been based on the four elements, which all in are essential in order to be considered a particular issue as a prejudication the theoretical disquistions have been supported by expamles from the adjudications of the administrative courts.
