Abstract in English

This article includes the characteristics and a detailed analysis of the issue of exercising the right to dispose of an emptied mortgage space. The institution of disposal of an emptied mortgage place has never functioned in the Polish legal system. Due to the lack of Polish literature, foreign materials were analyzed. The normative regulation and the functioning of analogical institutions in other jurisdictions were traced and contrasted with the provisions newly introduced into the Polish legal system. It is hoped that the study of this issue, will prove to be a useful resource for practitioners.
