The position of the President of the Republic of Poland in the area of foreign affairs

Celem niniejszej pracy jest przedstawienie i przeanalizowanie konstytucyjnej pozycji Prezydenta Rzeczypospolitej Polskiej, jako reprezentanta państwa w stosunkach zewnętrznych. Praca składa się z trzech rozdziałów. Pierwszy rozdział opisuje ewolucję pozycji głowy państwa w sferze stosunków zagranicznych od odzyskania niepodległości w 1918 doku do uchwalenia Konstytucji 2 kwietnia 1997 roku. Kolejne części pracy koncentrują się na obecnej regulacji, w szczególności na art. 133 Konstytucji RP. W drugim rozdziale w sposób ogólny została omówiona pozycja prezydenta Rzeczypospolitej Polskiej, jako reprezentanta państwa. Opisane tutaj zostały także prezydenckie kompetencje w sferze stosunków zewnętrznych, czyli: ratyfikowanie i wypowiadanie umów międzynarodowych, mianowanie i odwoływanie pełnomocnych przedstawicieli RP w innych państwach i przy organizacjach międzynarodowych oraz przyjmowanie listów uwierzytelniających i odwołujących akredytowanych przy nim przedstawicieli dyplomatycznych innych państw i organizacji międzynarodowych. Celem trzeciego rozdziału jest przedstawienie podstawowych problemów, jakie przyniosła praktyka ustrojowa (między innymi problemy odnoszące się do ratyfikacji Traktatu z Lizbony, projekty zakładające dodanie rozdziału „europejskiego” do Konstytucji). Praca podejmuje próbę uporządkowania zagadnień związanych z prezydenckimi uprawnieniami w przedmiocie stosunków zewnętrznych.

The purpose of this thesis is to present and analyze the constitutional position of the President of the Republic of Poland as representative of the State in foreign affairs. The thesis contains three chapters. First chapter describes evolution of the position of polish head of the state in the area of foreign affairs from restoration of independence in 1918 to the Constitution adopted on 2 April 1997. The next parts of the thesis concentrate on current regulation, especially on art. 133 of the Constitution of the Republic of Poland. The second chapter generally presents position of President of Poland as the representative of the State. The second chapter also describe presidential powers in the area of foreign affairs, which are: ratification and renouncement of international agreements, appointing and recalling the plenipotentiary representatives of the Republic of Poland to other states and to international organizations, receiving the Letters of Credence and recalling of diplomatic representatives of other states and international organizations accredited to President. The aim of the third chapter is to present basic problems, that had been appeared along political practice (inter alia problems refer to ratification of Lisbon Treaty, projects of transforming Constitution by adding “European”chapter). The thesis is an attempt to sort out the issues connected with the presidential powers in the area of foreign affairs.
