Artykuł jest odpowiedzią na artykuł Petera Kasiske pt. „Criminal Law and Behavioral Law and Economics”, w którym argumentuje on, że ustalenia ekonomii behawioralnej mają znaczenie nie tylko dla prawa rynku kapitałowego i prawa ochrony konsumentów, ale także dla prawa karnego. Celem artykułu jest zwrócenie uwagi na wątpliwości związane z wykorzystaniem ekonomii behawioralnej w prawie karnym oraz wskazanie granic jej zastosowania w tej gałęzi prawa.

The paper is a comment on the Peter Kasiske’s article “Criminal Law and Behavioral Law and Economics”, in which he argues that the findings of behavioral economics are of importance not only for capital market law and consumer protection law, but also for criminal law. The aim of the paper is to show the boundaries of the application of behavioral economics to criminal law. , to explicitly draw the readers’ attention to the potential dangers of such an application, and thereby to express doubts concerning the use of behavioral economics in criminal law. The main point is that behavioral economics and criminal law have different functions and different theoretical foundations (the former being descriptive and the latter being normative). This is why the influence of behavioral economics on criminal law should be seriously limited.
