Cartel and antitrust law

Tematem mojej pracy są kartele oraz uregulowania z zakresu prawa ochrony konkurencji i konsumentów dotyczących tej problematyki na płaszczyźnie amerykańskiej i europejskiej, a także polskiej przez wzgląd na członkostwo Polski w Unii Europejskiej i związaną z tym konieczność ujednolicania przepisów krajowych z wspólnotowymi. Dokonana została charakterystyka oraz opisanie istoty kartelu a punktem wyjścia do rozważań na temat stało się omówienie genezy, rozwoju a także zakresu prawa antymonopolowego. Praca zawiera porównanie zwalczania nielegalnych porozumień kartelowych oraz opis grożących sankcji za dopuszczenie się takiego naruszenia. Przedstawione zostały podobieństwa a także różnice między amerykańskimi a polskimi regulacjami. W rozdziale trzecim została opisana instytucja leniency jako remedium na działalność kartelową. Zawiera on ponadto genezę i zakres zastosowania programu łagodzenia kar pieniężnych w prawie ochrony konkurencji a ponadto porównanie funkcjonowania tego instrumentu na gruncie ustawodawstwa amerykańskiego i polskiego.

the subject of my thesis are cartels and regulations in the field of competition and consumer protection law concerning this issue at the American and European level, as well as Polish for the sake of Poland's membership in the European Union and the related necessity to harmonize national and Community provisions. Characterization and description of the essence of the cartel were made and the starting point for deliberations on this topic was the discussion of the genesis, development and the scope of antimonopoly law. The work includes a comparison of combating illegal cartel agreements and a description of impending sanctions for committing such an infringement. The similarities and differences between American and Polish regulations are presented. The third chapter describes the institution of leniency as a remedy for cartel activities. It also contains the genesis and scope of application of the leniency program in competition law and, moreover, the comparison of the functioning of this instrument under the American and Polish legislation.
