Online Gambling in the EU: the internal market and the discretionary power of member states

This dissertation deals with how the EU rules on the internal market affect the legal status of online gambling within the EU. Particular emphasis has been placed on the possibility for providers of online gambling services established within the EU of use of the freedom to provide services and freedom of establishment. This paper includes the analysis of the major rulings of the ECJ in this field. The court's findings were presented on the extent of the discretionary power of Member States wishing to restrict cross-border activities of such entities. This dissertation also includes reference to the regulation of e-gambling in Poland and the compliance of these rules within EU law.

Praca traktuje o tym, w jaki sposób przepisy unijne dotyczące rynku wewnętrznego wpływają na sytuację prawną hazardu internetowego na terenie UE. Szczególny nacisk położony został na możliwość korzystania ze swobody świadczenia usług oraz swobody przedsiębiorczości przez podmioty świadczące usługi hazardowe on-line, których siedziba znajduje się na terenie Unii. W pracy ma miejsce analiza najważniejszych orzeczeń ETS z omawianej dziedziny. Przedstawione zostały wnioski Trybunału na temat zakresu swobody, jaką dysponują państwa członkowskie chcąc ograniczać transgraniczną działalność takich podmiotów powołując się na ochronę wartości o charakterze nadrzędnym. Praca zawiera ponadto odniesienie do regulacji e-hazardu w Polsce oraz do zgodności tych przepisów z prawem unijnym.
