The rule that the Member States face the liability for damages for the infringement of the EU law is well established in the jurisprudence of the CJEU . This principle should be taken into account when applying and interpreting Polish provisions on the State's liability. However, so far, it had limited influence on the legislature enacting the provisions on the State's liability and very limited feedback in the Polish courts' jurisdiction. The article indicates and discusses the main discrepancies between Polish rules and the requirements of EU law concerning the scope of the State's liability.
