Metropolitan associations and municipal associations

Praca porusza problematykę związków metropolitalnych - niedawno wprowadzonej do polskiego porządku prawnego formy współdziałania jednostek samorządu terytorialnego. Opracowanie ma charakter porównawczy - instytucja związku metropolitalnego zestawiona została z ugruntowaną już w polskim systemie prawnym formułą związku komunalnego. Przedmiotem pierwszej części pracy jest instytucja związku komunalnego, natomiast w drugiej części scharakteryzowano instytucję związku metropolitalnego, porównując ją z instytucją związku komunalnego. Punktem odniesienia dla rozważań poświęconych związkom metropolitalnym jest ustawa o związkach metropolitalnych oraz ustawa o związku metropolitalnym w województwie śląskim. Zamierzony efekt pracy polega na próbie sformułowania odpowiedzi na pytanie: czy związki metropolitalne są instytucją odpowiadającą na problemy związane z zarządzaniem obszarami aglomeracji miejskich, czy też wystarczającym narzędziem są dotychczasowe formy współdziałania jednostek samorządu terytorialnego, w postaci związków komunalnych.

The work deals with the problems of metropolitan associations - recently introduced into the Polish legal order forms of cooperation of local government units. The study is comparative - the institution of the metropolitan association was compiled with the institution of the municipal association already established in the Polish legal system. The subject of the first part of the work is the institution of the municipal association, while in the second part the author characterized the institution of the metropolitan union, comparing it with the institution of the municipal association. The point of reference for the discussions on metropolitan associations is the Metropolitan Associations Act and the Metropolitan Associations Act in Silesia Voivodeship. The intended effect of the work is to try to answer the question: are metropolitan unions an institution responding to problems related to the management of urban agglomerations, or are municipal associations a sufficient tool to resolve those problems.
