Witch trials in the context of inquisitorial procedure in XV - XVIII centuries

Celem niniejszej pracy jest przedstawienie specyfiki procesów o czary w kontekście procedury inkwizycyjnej stosowanej przez instytucje kościelne i świeckie w wiekach od XV do XVIII.Praca zawiera cztery rozdziały oparte na czterech aktach prawnych i dwudziestu ośmiu pozycjach literatury.W pierwszym rozdziale znajduje się omówienie rozwoju procesu inkwizycyjnego ze szczególnym uwzględnieniem postępowania w sprawach o herezję jako mających ogromny wpływ na późniejsze procesy o czary.Drugi rozdział poświęcony jest opisowi procedury inkwizycyjnej stosowanej przez instytucje kościelne oraz niemieckie i francuskie organy państwowe.Trzeci rozdział zawiera opis procesów o czary, ich przebieg i najważniejsze elementy. Duży nacisk został położony na przestawienie tortur jako mających wielkie znaczenie wobec eskalacji procesów w tych sprawach.W ostatnim rozdziale scharakteryzowano zjawisko "polowania na czarownice", jego ramy czasowe i geograficzne oraz dynamikę rozwoju, a wreszcie przyczyny wygaśnięcia.Głównym założeniem pracy jest przedstawienie podejścia ówczesnych do oskarżeń o czary i konsekwencji jakie miało ono na zmianę zasad procesu inkwizycyjnego by dostosować go do specyfiki procesów o czary.

The aim of the following thesis is to present the specifics of witch trials in the context of inquisitorial procedure used by church and secular institutions in XV-XVIII centuries.The thesis consists of four chapters written according to the analysis of four normative acts and twenty-eight items of literature.In the first chapter there is a description of the inquisitorial system development with the special attention to heretics trials according to the fact of their major impact on later witch trials.Second chapter is devoted to the presentation of inquisitorial procedure used by church and German and French secular institutions.Third chapter consists of the description of witch trials, its course and most important elements. Special consideration was given to the issue of tortures as it affected the escalation of these kind of trials.In the last chapter there is a characterisation of the "with hunt" phenomenon, its time and geographical frame, dynamics and finally, reasons why it came to an end.The main assumption of the thesis is to present the attitude towards the accusations of witchcraft and its consequences on the fact of changing rules of inquisitorial procedure to the specisics of witch trials.
